That the Committee of Adjustment confirm the agenda, as circulated.

THAT minor variance(s) from the provisions of By-law No. 2010-001-ZO, as amended, for File No. CA-21-22 BE AND ARE HEREBY GRANTED to permit i.) A minimum front yard of 5.2 metres whereas Section 5 Table 5.2 of the by-law requires a minimum front yard of 10 metres; and ii) A minimum interior side yard (east) of 1.8 metres whereas Section 5 Table 5.2 of the by-law requires a minimum interior side yard of 3.5 metres; and iii.) A minimum interior side yard (west) of 1.2 metres whereas Section 5 Table 5.2 of the by-law requires a minimum interior side yard of 3.5 metres; and iv.) A maximum lot coverage of 27.2 percent whereas Section 5 Table 5.2 of the by-law permits a maximum Page 9 of 9 Committee of Adjustment Minutes September 15, 2021 lot coverage of 15 percent, in conformity with the plan(s) attached to the Staff Report, subject to the following condition(s): 1. That the Owner provide a Lot Grading Plan and Erosion and Sediment Control Plan, prepared, signed and stamped by a qualified professional Engineering Consultant, for review and approval, to the satisfaction of the Town’s Engineer together with all securities as required by the Town; and 2. The Owner be responsible to pay all applicable fees for the review of the Engineering plans referenced in condition no. 1 above, in accordance with the Town’s Fees and Charges by-law

THAT minor variance from the provisions of By-law No. 2010-001-ZO, as amended, BE AND IS HEREBY GRANTED to permit a maximum height of 10.8 metres whereas the by-law permits a maximum height of 10.0 metres, in conformity with the plan(s) attached to the Staff Report.

THAT minor variance from the provisions of By-law No. 2010-001-ZO, as amended, BE AND IS HEREBY GRANTED to permit a maximum lot coverage of 37.2 percent whereas Section 5 Table 5.2 of the by-law permits a maximum lot coverage of 35 percent, in conformity with the plan(s) attached to the Staff Report,

THAT minor variance from the provisions of By-law No. 2010-001-ZO, as amended, BE ARE HEREBY GRANTED to permit i.) a minimum interior side yard of 1.5 metres whereas the by-law permits an interior side yard of 3.5 metres; and ii.) a maximum lot coverage of 25 percent whereas the by-law permits a maximum lot coverage of 15 percent, in conformity with the plan(s) attached to the Staff Report, subject to the following condition(s): 1. The applicant provides a Site Servicing and Grading Plan to be approved by the Town’s Engineering Department; and 2. The applicant provides securities for Grading and Erosion and Sediment Control Measures; and 3. The applicant pay all relevant fees for Engineering review as determined by the Town’s Engineering Department.
